Terms of Service for FlyerFly

Effective Date: Upon account sign-up

These Terms of Service ("Terms") govern your access to and use of the FlyerFly mobile application on iOS and Android (the "App"). 

FlyerFly is operated by Sandoval Luis Consulting LLC, a Wisconsin limited liability company (“FlyerFly,” “we,” “our,” or “us”).

By creating an account or using FlyerFly, you agree to these Terms. If you do not agree, do not use the App.

FlyerFly accounts are designated for students using a valid school-issued email address.

4. User Content

You are responsible for any content you upload, post, or share through FlyerFly, including:

 By submitting content, you grant FlyerFly a non-exclusive, royalty-free, worldwide license to host, store, display, reproduce, and distribute your content solely for the purpose of operating, maintaining, improving, and promoting the App.

FlyerFly reserves the right to review, moderate, remove, or restrict access to content at its discretion to:

Moderation is conducted to maintain community safety, comply with school rules, and enforce these Terms.

Schools do not have backend access to FlyerFly systems and do not directly moderate content. Schools may report concerns to FlyerFly, which evaluates and acts on them as appropriate.

FlyerFly does not guarantee that all inappropriate content will be identified or removed.

However, FlyerFly maintains a zero tolerance policy regarding objectionable content and abusive users. Content reported to us that violates these Terms will be removed within 24 hours of being reported, and users who repeatedly violate these Terms will be permanently banned.


6. Prohibited Conduct

6.1 Child Safety and Zero Tolerance (CSAE) 

FlyerFly maintains a Zero Tolerance policy regarding Child Sexual Abuse and Exploitation (CSAE). You strictly agree not to use the App to publish, share, or solicit Child Sexual Abuse Material (CSAM), or to engage in grooming, sextortion, or the sexualization of minors.

Legal Reporting: We are legally obligated to, and will, report confirmed instances of CSAE/CSAM to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities.


7. Account Suspension and Termination

FlyerFly may suspend or terminate your account at any time if:

You may delete your account at any time directly through the App. Account deletion is permanent and cannot be undone.


8. Intellectual Property

The App, including its design, features, branding, and trademarks, is owned by FlyerFly or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the App without prior written permission.


9. End User License Agreement (EULA)

Subject to your compliance with these Terms, FlyerFly grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the FlyerFly mobile application on a personal device that you own or control, solely for your personal, non-commercial use and in accordance with these Terms.

The App is licensed, not sold. FlyerFly and its licensors retain all right, title, and interest in and to the App, including all intellectual property rights.

You may not:

This license will automatically terminate if you violate these Terms. Upon termination, you must cease all use of the App and delete all copies from your device(s).

This EULA is independent of Apple Inc. Apple is not a party to this agreement and has no responsibility for the App or its content.


10. Privacy

Your use of FlyerFly is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you agree to the practices described in the Privacy Policy.


11. Disclaimers

FlyerFly is provided "as is" and "as available." 

We do not guarantee that:

User-Organized Events.
Most events listed on the App are created and organized by individual users or clubs. FlyerFly does not supervise, control, or guarantee the safety, legality, or quality of user-organized events and is not responsible for the conduct of organizers or attendees at such events.

FlyerFly-Hosted Events.
In limited cases, FlyerFly may organize or host promotional, onboarding, or community events. Any such events will be clearly identified as FlyerFly-hosted and may be subject to additional terms, waivers, or on-site rules provided at the time of the event.

FlyerFly is not responsible for the actions, content, or conduct of users or third parties.


12. Limitation of Liability

To the fullest extent permitted by law, FlyerFly and Sandoval Luis Consulting LLC will not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the App.

In no event shall FlyerFly’s total liability to you for any claims arising out of or relating to the App exceed one hundred dollars ($100) or the amount you paid to FlyerFly in the twelve months preceding the claim, whichever is greater.


13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles.


14. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify users through the App or other appropriate means. Continued use of FlyerFly after changes means you accept the updated Terms.
